Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the websites, services, programs, events, and communications offered by Tribu Pura Vida LLC ("Tribu Pura Vida," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

By using our services — including visiting our websites, registering for events, enrolling in programs, joining our community, or providing your mobile number for SMS — you agree to these Terms and to our Privacy Policy. You must be at least 18 years old to use our services.

2. Description of Services

Tribu Pura Vida provides real-estate-investing education, mentoring, workshops, community access, in-person and virtual events, and related content, marketed primarily to the Latino community in the United States. Services include but are not limited to the TMTV-2026 event, the Fix & Flip programs, the Programa Élite, and ongoing member coaching.

3. SMS / Mobile Messaging Terms

Read this section carefully if you provide your mobile number to us.

By providing your mobile phone number on any Tribu Pura Vida form and checking the SMS consent box, you agree to receive recurring SMS messages from Tribu Pura Vida at the number you provided. Message frequency varies depending on your interactions with our services and the programs you have enrolled in.

  • Message and data rates may apply. Tribu Pura Vida does not charge for sending messages, but your mobile carrier may charge you for received or sent messages.
  • Reply HELP at any time to receive customer-service contact information.
  • Reply STOP at any time to unsubscribe. You will receive a one-time confirmation message and no further messages will be sent. If you change your mind, you can re-subscribe by submitting a new opt-in form.
  • Consent to receive marketing SMS is NOT a condition of any purchase, registration, donation, program enrollment, or other service.
  • Two message streams:
  • Marketing messages: promotions, event invitations, educational content, special offers. You may opt in or out of this stream independently.
  • Transactional messages: appointment reminders, account notifications, event logistics, payment confirmations, customer-service follow-ups. You may opt in or out of this stream independently. Some services require transactional SMS to function (for example, appointment reminders for one-on-one mentoring).
  • Quiet hours: We do not send SMS between 9:00 PM and 8:00 AM in your local time zone, except for time-critical transactional messages you have explicitly subscribed to.
  • Carriers supported: All major US carriers, including AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, Cricket, MetroPCS, US Cellular, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.
  • Privacy: Your mobile number and SMS consent records are governed by our Privacy Policy. We do not share mobile information with third parties or affiliates for marketing purposes. See the "Mobile Information and SMS Consent" section of our Privacy Policy for details.

4. Eligibility and Account Registration

To register for our programs you must be at least 18 years old and a legal resident of the United States. You agree to provide accurate, current, and complete information when registering, and to keep that information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

5. Payments, Refunds, and Donations

Program fees, event tickets, and donations are processed by third-party payment processors. All charges are in US Dollars. Refund eligibility is described on the individual program or event page. Donations are non-refundable except where required by law.

6. Intellectual Property

All content on our websites and in our programs — text, video, audio, images, course materials, frameworks, and proprietary methods — is owned by or licensed to Tribu Pura Vida and is protected by US and international copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any of our content without our prior written consent.

7. User Conduct

You agree not to use our services for any unlawful purpose or in violation of these Terms; harass, abuse, defame, or threaten other users or our staff; upload viruses, malicious code, or attempt to interfere with the operation of our services; use automated means to access or scrape our sites without our written consent; or resell, redistribute, or transfer access to any program, event, or content.

8. Disclaimers

Our programs provide educational content. We do not guarantee any specific financial, business, or investment outcome. Real-estate investing involves risk, including the potential loss of principal. Past performance is not indicative of future results. You are solely responsible for your own investment decisions. Consult licensed professionals (attorneys, accountants, financial advisors) before acting on any information we provide.

Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Tribu Pura Vida LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or related to your use of our services. Our total liability for any direct damages arising from these Terms shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred US dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Tribu Pura Vida LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to our services at any time, with or without cause and with or without notice, including for violation of these Terms. Sections 6 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), and 13 (Dispute Resolution) survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles. Any action arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in New Haven County, Connecticut, and you consent to the jurisdiction of those courts.

13. Dispute Resolution

You and Tribu Pura Vida agree to first attempt to resolve any dispute informally by contacting info@tribupuravida.com. If we cannot resolve the dispute within 60 days, either party may pursue formal dispute resolution as permitted by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms here with a new effective date. Material changes to the SMS / Mobile Messaging Terms section will require renewed opt-in from existing SMS subscribers.
